Constitutional Tribunal of Union gives opinion that extension of duration of state of emergency in the entire country is constitutional

    The Pro Tem President sought the opinion of the Constitutional Tribunal of the Union over whether measures taken in accordance with section 425 of the constitution and extension of the duration of the state of emergency declared in the entire country by a six month period each time by the National Defence and Security Council in accordance with section 425 of the constitution as of 1st February, 2023 were in conformity with the constitution as the current situation

is not ripe for the Commander-in-Chief of Defence Services to submit the report for accomplishment assigned duties in accordance with section 426 of the constitution and due to extraordinary circumstances. It was reported that the Constitutional Tribunal of the Union, after taking related terms of the constitution of the Republic of the Union of Myanmar into consideration, responded to the Pro Tem President on 31st January, 2023 that extension of the duration of the state of emergency declared in the entire country by a six month period each time by the National Defence and Security Council as of 1st February, 2023 in accordance with section 425 of the constitution is constitutional.
